On February 26, 2022, the woman, who was in an advanced state of pregnancy, going through her 39th week of pregnancy, was rushed by her husband to the on-call hospital “Hippocrateo”. As described in the lawsuit, she had excruciating pain and uterine contractions, with blood, while she was an asymptomatic patient of the Covid-19 disease and vaccinated with two doses.
“We arrived at Hippocrates around 7.00 in the morning and specifically at the Emergency Department, where although I declared the criticality of my condition, it was only at around 7.20 that a doctor or specialist doctor took charge of my condition and performed an ultrasound and supposedly a cardiotocogram! I was surprised to hear that because the hospital’s duty was ending in half an hour, they refused to admit me and submit me to an immediate procedure to give birth, even with a caesarean section, since already giving my history, I told them that I have given birth twice more healthy children, again by caesarean section. So I was kicked out at around 7.30am. from Hippocrates Hospital, telling me to go to Papageorgiou Hospital, which at 8.00 am. he was starting his own vigil. In fact, as I mentioned, they also refused to transport me by ambulance even though I was in a terrible state from the pain and the blood”the complainant states in her lawsuit.
“At the Papageorgiou hospital I was initially admitted around 8.40 am, instead of a gynecology clinic to give birth, to a Covid-19 clinic in the Emergency Department (ED) and an hour later, at 9.40 am, to the same day, I was admitted to the maternity clinic for emergency, immediate caesarean section surgery, where finally an hour later, that is at 10.30 am. I gave birth by caesarean section to a non-pulsating, male, mature newborn under iliac projection, having already suffered from the criminal refusal, but also from the delay of the two hospitals, placental abruption and uterine rupture. adds the mother.
The newborn was immediately intubated with ischemic hypoxemic encephalopathy and from then until his death – on June 21, 2022 – he remained hospitalized in the Neonatal Intensive Care Unit of the Papageorgiou hospital. The mother was hospitalized in serious condition due to placental abruption and uterine rupture for eight days from February 26 to March 4, 2022.

At the same time, they do not attribute any responsibility to the doctors of the Neonatal Intensive Care Unit (NICU) of “Papageorgiou”, where the infant was taken intubated and despite the persistent efforts of the director and the medical staff, it was not possible to remedy the situation.
The family’s lawyer Charalambos Apostolidis stated in GRTimes that: “Unfortunately, this case is the same and identical to that of the “Agios Andreas” hospital in Patras. While a woman about to give birth was found to be bleeding, they kicked her out of the hospital because their shift ended in half an hour, instead of rushing her to a caesarean section. The three-hour delay resulted in a child being born with hypoxemic encephalopathy and ultimately dying, and she was in serious danger. Such criminal negligence must be severely punished.”
