Special court: The request of former Appellate Prosecutor Georgia Tsatani to be presented as a civil action was rejected

The Special Court on Ministerial Responsibility, in which the former Deputy Minister of Justice, Dimitris Papagelopoulos and the former head of the Corruption Prosecution, Eleni Touloupaki, are on trial, rejected the request of the former Appellate Prosecutor, Georgia Tsatani, to be presented as a civil action (showing support for the accusation against Mr. Papagelopoulos for the crime of breach of duty). That is, Mrs. Tsatani cannot be presented as a civil action in support of the charge against Mr. Papagelopoulos.

Previously, Olga Smyrli, prosecutor of the seat of the Special Court on Ministerial Liability, proposed to reject the request of Mr. Papagelopoulos’s lawyers not to accept the representation of the former Appellate Prosecutor Georgia Tsatani, as a civil action.

With the start of today’s third consecutive day of hearings at the Special Court, Mrs. Smyrli proposed to accept the objection of Mr. Papagelopoulos’s lawyers that Mrs. Tsatani’s procedural right has been barred. And this is because Mrs. Tsatani had filed a statement of civil action on 16.2.2022 and the oldest (2018) statement she had submitted did not concern the case that is now being tried, but another case, of this bombing against her. The advocates of Mrs. Tsatani opposed the proposal of the district attorney, while on the contrary, the lawyers of Mr. Papagelopoulos characterized the prosecutor’s proposal as well-founded and agreed with it.

Then the defendants’ lawyers submitted a request to cover the whole trial live (live broadcast). They argued that the live broadcast of the trial is provided for by the current legislation (law 3090/2002), after a relevant decision of the Special Court, as long as good morals are not violated, which in this particular case does not exist. They also argued that the importance of the trial is of great interest as Mr. Papagelopoulos is a former public prosecutor and had a political capacity, in addition to the other positions he served, while Mrs. Touloupaki is an active public prosecutor.

For his part, Mr. Papagelopoulos took the floor on the request for televised coverage of the trial and emphasized: “I will set a human parameter. My personal drama. They’ve been trying to break me for five years. I want the truth, they show me as a criminal, what Rasputin, what this… When the independent judiciary said that all this is not true (s.s.: Will of the Judicial Council), it was leaked that I am accused of a bunch of crimes. I have confidence in Justice, the truth will be proven, the Greek people will know it”.

The court adjourned to rule on the lawyers’ request.
