With objections and tensions, the proceedings in the trial before the Five-member Court of Criminal Appeals for the Golden Dawn case continued.

On the side of the defense of Nikos Michaloliakos, issues were raised regarding his summons to the court with the lawyers initially arguing that it is invalid and then that his signature on the document has been forged. “See if there is a connection between this signature and what you have in the case file. “His signature is fake,” said Dim. Papadellis, lawyer of Nik. Michaloliakos.

The district attorney emphasized that in her opinion “the document is genuine but in any case the objection is inadmissible, because it must name a forger”.
Mr. Papadellis insisted and asked to adjourn the court and call Nick’s doctors. Michaliakou to testify if he was able to sign. The request was rejected by the Court.

The defense attorneys then filed an objection of inadmissibility of the appeal of the Prosecutor of Appeals in which the sentences for the management of a criminal organization and for the attempted murder of Abuzid Ebarak were found to be low.

Ilias Kasidiaris also took the floor, stating: “There is only one specific reference to me in the Prosecutor’s appeal for a statement that is not mine. From this it follows that there is no specific and thorough justification. This reference to me is false. There were many statements of mine that day beginning with the conviction of the crime. This particular case is full of lies.”

The public prosecutor suggested that the appeal be rejected, a suggestion that was also accepted by the court. The prosecutor then read the content of the appeal of the Appellate Prosecutor. Ilias Kasidiaris asked for the reason in order to deny the accusation.
“I categorically deny the charge and I reject it. It is characterized by a lack of any act. It is non-existent, baseless, malicious and offends the truth and the rules of justice. This is not my position but that of the president of appeals and rapporteur of the judicial council who requested the acquittal. In the first-instance trial, the district attorney and current vice-prosecutor of the Supreme Court, with her proposal, debunked the accusation and proved my innocence with strong arguments. The purpose is to harm the free expression of political views. The head of the Appellate Prosecutor’s Office, who drafted the prosecution proposal for the Baltakou case, states that an investigation must be conducted into the pressures on the prosecutor who drafted the charge. I have an obligation to point out that I am the only citizen in the European Union on whom a communication ban has been imposed, I am forbidden to speak with close people from my environment, my colleagues at work and the party. I will prove my innocence. As a member of parliamentary committees I defended the independence of the judiciary. I am a member of one of the parties that now dominates all over Europe,” said the person accused of running a criminal organization, among other things.

Subsequently, the defense of Yiannis Lagos, for the second time, since the beginning of the trial, requested the suspension of the execution of his sentence. The defendant asked the court to speak and emphasized, among other things: “It is unheard of to have seven leaders in a criminal organization, while for seven years we heard about the beginning of one leader. The fact that he is in prison makes me very sad. I have been imprisoned for 38 months. They know they are lying and have sent 48 innocent people to prison. For nine years we have been everywhere. We were never given the opportunity to respond to the media. It’s funny that I express Nazism and fascism in Greece because I was born in Perama, and not the stupid politicians who have destroyed the country”.

The district attorney reserved her opinion on the request.

The trial will continue on October 7 with the testimony of Magda Fyssa.
