The labeling of products in the “household basket” is mandatory from December 1

Stores must ensure that the products they declare in the list of consumer products and which are sent to the Ministry of Development are adequate

From December 1st the new label for the “household basket” will be on the shelves of supermarkets in order to facilitate consumers in their purchases

Also included in the decision of the Ministry of Development and Investments is an amendment-clarification to the list of 51 product categories that concerns two product categories (in positions 27 and 28).

In the table included in the new decision, reference is made to “infant cream” and “infant milk”, while in the table of the first decision – in the same positions – there were the categories “infant formula (baby food)” and “infant milk (children’s foods)’.

Regarding the use of the trademark of the “household basket” initiative, the following provisions are provided:

  • Informing the consumer public about the products participating in the “household basket” initiative is mandatory through a special mark placed on the products or in their physical or electronic sales area or in any means by which the products are advertised to the consumer. In addition, a clear list / catalog of the products that make up the household basket is posted at the entrance of each store, as well as the prices at which the products are offered.
  • The special mark must be placed next to the purchase price of each product included in the “household basket” on the shelf on a separate tab. The tag has a square or rectangular shape, with dimensions at least equal to 8 cm x 8 cm, or has a circular shape, with a diameter at least equal to 8 cm, on which the special (colored) mark is printed.
  • The obligation to apply the above dimensions of the special mark starts from December 1, 2022.
  • Businesses participating in the “household basket” initiative can obtain access to the special badge by sending a request to the email address [email protected].
  • The use of the special mark by businesses that do not participate in the “household basket” is prohibited. Businesses that violate the above prohibition are subject to administrative penalties.
  • It is forbidden to use the special mark on products that do not participate in the “household basket” initiative and have not been declared with the list of consumer products that each company has sent to the Ministry of Development. Businesses that violate the above prohibition are subject to administrative penalties.
  • Sufficiency of products participating in the “household basket” initiative

The obligors ensure that the products declared in the list of consumer products (“household basket”) sent to the Ministry of Development and Investments are in their stores in sufficient quantity and are made available to the consumer public unhindered.

If the stocks of a product participating in the “household basket” run out in one or more stores, the debtors, temporarily replace the out-of-stock product with a similar product available at the same or lower price and in the same or greater quantity.

If there is no such product in the store, the obligees ensure the supply of the store where the product sold out within 2 days with a sufficient quantity of the sold-out product or inform the Ministry of Development and Investments and the e-katanalotis digital platform for its definitive replacement product in all their stores.

The new product should also be in adequacy. Definitive product replacement is allowed only once until the new regular product catalog submission.

The above paragraphs do not apply to products that must be kept in a refrigerator or freezer.

Penalties

Businesses that violate their obligations are subject to an administrative fine of 2,000 euros per store in which the violation occurs.
