Aware of the real problems of justice, a product of the 40-year judicial journey the Prosecutor of the Supreme Court Isidoros Dogiakosspoke to prosecutors, holding everyone accountable for the state of our justice system and primarily the prosecutors themselves.

Mr. Dogiakos, speaking at the annual general assembly of the Union of Prosecutors, asked all prosecutors to “increase their individual responsibility at all levels”, in order to contribute to improving the state of justice, recognizing the existence of serious problems and insisting , that the solution does not lie in increasing the number of judicial and prosecutorial officers but in changing the existing mentality.

The position of the Prosecutor of the Supreme Court caused a sensation as he noted that “it is a fact that some of the long-term problems have now created a kind of dangerous addiction that inactivates its reflexes and poisons public opinion against it”. .

The chief prosecutor also referred indirectly but clearly to the criticisms leveled at the judicial investigation of allegations of communications surveillance, noting with emphasis.

“Investigations will proceed yesterday, with the available data and evidence, and the prosecution authorities will do the best they can in the shortest possible time.”

The individual responsibility of prosecutors

Mr. Dogiakos, referring to the achievement of the speed of adjudication of cases, to the quality and reliability of the judiciary, emphasized that what is required is “the increase in the degree of individual responsibility of each individual at all levels without exception” and added:

“The members of the Judiciary, each one from the position he holds, with a little more effort in combination with his spiritual and intellectual abilities can certainly offer more than he already offers, so that combined the individual efforts of all will yield the best possible result .

Increasing the individual responsibility of each member of the Judiciary will be a strong bulwark for convincingly rebutting malicious attacks and dealing with the difficulties, but also enemies (ideal or real) that he faces.

Only a radical change of mentality and voluntary assumption of heavier responsibilities could help, if not to solve, at least to reduce the pressure of the problems of Justice”.

At another point, the supreme prosecutor pointed out that “objectively, the officers of Justice are considered and must be persons of increased intelligence and intellectual abilities in general. This advantage and more, clearly, give them the ability to fully understand needs and problems and choose an appropriate and effective way to deal with them.
And I am sure that they can perceive that one of these ways is to increase their individual responsibility towards the institution they serve. Of course, this does not mean that they are now irresponsible. I just think they should offer something more than what they are currently offering from their uncontrolled reserves. One thing is certain. That people with inspiration and ideals different from today’s are needed in order to achieve the desired and useful result for everyone”.

Mr. Dogiakos did not fail to mention that “the rapid increase in the organic positions of judicial and prosecutorial officers is not the only way to solve or improve the problems of Justice” and added that society wants to love and respect “that prosecutor who serves his institutional position honestly, conscientiously and honestly and has a strong and lively presence”.

Teletrials and the presumption of innocence

Kaustikos was the Prosecutor of the Supreme Court for the phenomenon of continuous violations of the presumption of innocence with the teletrials and the presentations of the lawyers on the channels.

“The battles between “television lawsuits” and the presumption of innocence are daily…exaggeration and moderation, calmness and tension, ignorance and knowledge, honesty and intentionality are opposed every day.

Teletrials at their peak. The televised stage is contested by “various” people and they allegedly fight for the truth and all they ultimately achieve is to abuse it systematically and consciously. When it comes to lawyers, some of them expect a lot from their presence in the teletrial, despite the fact that their image is not convincing and their abilities. They usually don’t make it. However, they succeed in demonstrating their legal inadequacy, arrogance and arrogance with certainty.”

150 thousand lawsuits

For his part, the president of the EEE, Appellate Prosecutor Evangelos Bakelas, pointed out that it is common acceptance that the Justice is not effective and there are delays that do not meet the expectations of the citizens, while he described the establishment of the Judicial Police as positive.

At the same time, Mr. Bakelas stated that annually 150,000 lawsuits are filed in the Athens Prosecutor’s Office and 50,000 lawsuits in the Thessaloniki Prosecutor’s Office.

Furthermore, the president of the EEE, in the context of improving the effort to speed up the Judiciary, referred to the necessity of filling the vacant organizational positions of judicial officers, pointing out that there are Prosecutor’s Offices with only one judicial officer (s.s.: it was mentioned by another speaker that in Crete there is a Prosecutor’s Office which has no court clerk), as well as in the lack of courtrooms.

Mr. Bakelas did not fail to emphasize that prosecutors are being attacked and threatened by lawyers handling criminal cases.
From the Ministry of Justice, Deputy Minister Giorgos Kotsiras spoke at the assembly of prosecutors, noting the efforts of recent years to solve the problems of justice.

“Justice, he emphasized, among other things, despite the difficulties, has been radically and effectively transformed over the last three years, with the quality of judicial services being upgraded through digitization and institutional interventions (e.g. Judicial Police), the infrastructures being improved ( new courthouses are being built after years throughout the country) and human rights to be further protected. The Judiciary is also strengthened substantially, with reforms and amendments that consolidate the safety and protection of society as a whole. This effort continues unabated.”
