With a simple certificate of an engineer and not necessarily with an electronic building ID, the transfers of real estate will be made until January 31, 2022, as announced by the Panhellenic Federation of Property Owners.

As mentioned, an amendment was submitted to Parliament by the Ministry of Environment and Energy, which gives flexibility in real estate transfers.

The announcement of POMIDA in detail:

Justification of the hard struggle of POMIDA and the other organizations that mobilized, is the submission of an amendment of RIS according to which will be allowed the preparation of notarial deeds of real estate transfer with a simple certificate of engineer until January 31, 2022, and not necessarily with electronic building ID.

POMIDA insisted until the end on its request at least RIS to harmonize its policy with the Prime Minister’s announcement for tax-free parental benefits and with the monthly extension given by the Ministry of Finance for notarial deeds with the old objective values ​​of real estate.

We hope that the example of Mr. Skrekas and Mr. Tagaras will be followed by the Ministry of Interior regarding the monthly extension of the platform for the undeclared squares, but also for the automatic extension of the validity of the TAP certificates, because otherwise, apart from the unjust suffering of the citizens, the Municipalities of the country will be obliged to reissue within January tens of thousands of TAP certificates without collecting a single euro …

What is an Electronic Building Identity

The process of creating an electronic file of a building that includes all the information related to it, such as:

  • Floor plans.
  • The energy efficiency certificate.
  • The building permit.
  • The declarations of inclusion in laws suspending the imposition of sanctions on arbitrary.
  • The millimeter table.

Apart from buildings, the same legislation also covers unstructured plots / plots as well as independent subdivided properties.

The Electronic Building Identity Card must be issued:

  • When transferring all real estate.
  • In order to complete and permanently exclude from the demolition the arbitrary category 4. Those inside the front yard are excluded.
  • For all new buildings and shared properties.
  • When issuing a building permit or approving small-scale works (eg addition of a floor, radical renovation, etc.).
  • For public buildings, schools, hospitals, etc. within 5 years.

How long does it take

After completing all the necessary documents and information, a Certificate of Completeness of Identity is issued. The Building / Divided Ownership Certificate of Completeness bears a unique number and receives a key of authenticity. In essence, the Certificate of Completeness is the document that will be used in all legal acts provided by the relevant legislation and replaces the requirement for an engineer certification of arbitrariness, while attaching the energy certificate. Its validity is 2 months from the date of issue, which coincides with the date of autopsy.

When a new Certificate of Completeness of Identity is needed the process does not have to be done from the beginning, the engineer simply confirms if any changes have been made to the required documents, makes the required update and issues a new certificate.

The supporting documents for the registration of Electronic Building Identity

According to law 4495, the following supporting documents are required:

  • The study of distribution of building costs (if any).
  • The millimeter table (refers to common areas or independent shared property).
  • The construction inspection certificate (if issued).
  • The energy performance certificate of parts or the whole building.
  • The Bulletin of Structural Vulnerability Arbitrary (DEDOTA) and / or the study of static adequacy and / or the Technical report of static control (if requested).
  • The floor plans, the accessibility study of disabled people or people with disabilities and the characteristic facades and sections (if required).
  • The declarations of inclusion in laws suspending the imposition of sanctions by arbitrary.
  • The executives (and the updates / revisions) of the construction works (eg, Building Permit or Construction).

The Electronic Building Identity will be the last step of the final settlement of the arbitrary buildings which have been included in the relevant laws, as only with its acquisition the settlement will be considered complete.

The new buildings and divided properties for which new building permits are issued will be obliged to obtain an electronic identity, while the older buildings will have to acquire it at the time of their transfer since the relevant declaration will be obligatorily attached to the contract.

In case a statement of false information is found, apart from the criminal sanctions, a fine is provided, the amount of which ranges from 2,000 to 20,000 euros, depending on the area that has not been imprinted on the Electronic Building Identity Card. The limits of the sanctions are doubled, if there is a recurrence of the violations and if they concern construction works in traditional settlements, areas of special natural beauty and protected areas.
