Rhodes: Doctors diagnosed a cold and he died of a heart attack a short time later

At Justice the family of a 49-year-old man from Rhodes appealed, asking for compensation of 400,000 euros from the doctors who, in May 2021, diagnosed a “simple cold”, but the unfortunate man died shortly after a heart attack.

His 41-year-old wife filed a lawsuit against the hospital of Rhodes in which she claims the sum of 400,000 euros for the mental suffering she and her three-year-old child have suffered.

The lawsuit was submitted to the Three-member Administrative Court of First Instance of Rhodes and apart from the money for mental suffering, the court is asked to issue a decision obliging the hospital to pay the 41-year-old a lump sum of 5000 euros as compensation due to monthly deprivation of maintenance for the minor child, rising in the amount of two hundred and fifty euros for the period from the day after the date of the 49-year-old’s death and for 20 months until her pension is issued.

According to what is mentioned in the lawsuit, everything started and ended within a few hours.

The 49-year-old man, who was married to the 41-year-old woman and they also have a child who is now three years old, on May 20, 2021 at 9.15 in the evening he felt intense discomfort in his back, which caused him discomfort and pain, and lasted for more than half an hour.

As the 49-year-old he was afraid for a heart attack, he was rushed to the Emergency Department of the hospital for examination, and hospitalization if required.

As emphasized, among other things, in the lawsuit, the pains experienced by the 49-year-old were extremely intense, since in addition to the discomfort and difficulty in breathing, he could not move easily and unaided, since his normal walking was interrupted by intense chest pains, and he was seized by a feeling of fatigue and weakness, realizing himself the need to go to the hospital for his treatment.

The 49-year-old accompanied by his wife they went to the hospital and there he was examined by a doctor in the Emergency Department where they took his history, had an electrocardiogram and a blood test.

After the examinations were completed, the doctor who had taken care of him decided – as stated in the lawsuit – “that it didn’t run reason for staying and monitoring the 49-year-old in the hospital, as he was suffering from a simple “cold” for the treatment of which it was sufficient to take the appropriate medicines only, and suggested that after the completion of the procedure and the examination of the patient, they should return to their home in about an hour 11.30 p.m. of the same day, failing, however, due to a lack of diligence in the performance of his duties, to refer them to a cardiologist in the first place, as he should have done and as it unfortunately turned out afterwards that it was necessary.”

The couple left the hospital relieved that it was nothing serious, and before going home, they stopped at a pharmacy to pick up analgesic anti-inflammatory drug which the above doctor had suggested to them for the relief of his “cold” during his diagnosis.

When they arrived at the pharmacy, the 41-year-old woman remained in the car and the 49-year-old man went inside to get the medicine.

“Within ten minutes, the 41-year-old was approached by a customer of the pharmacy to ask if she was with the gentleman who entered the pharmacy and had collapsed.

Frightened, the 41-year-old entered the pharmacy, where she saw that her husband was in a miserable condition, suffering from great discomfort, unbearable pain, chest discomfort and a terrible feeling of weakness, a situation which literally terrified her because she could not believe that although they had left the hospital, with the assurance of the above doctor, that it was nothing serious, on the contrary it was (allegedly) a simple “cold” and there are no reasons for particular concern but (and above all) hospitalization and monitoring, the state of the husband’s health his condition worsened to the point of literally collapsing, after he lost consciousness in a few minutes, despite the efforts of the pharmacist to “revive” him with cardiopulmonary resuscitation (CPR) in the context of first aid and before the EMS arrived, and while the 41-year-old he was literally in shock.

Finally, the unfortunate 49-year-old breathed his last after being taken to the defendant hospital at 00.30 am. of 21/5/2021″.

In the same lawsuit, reference is also made to the causes of the 49-year-old’s death, which, according to the medical examiner’s report, was due to a myocardial infarction.

The 41-year-old emphasizes in her lawsuit that she he doesn’t work as she is raising her minor child and their only income was her husband’s salary.

However, after his death she now receives a minimum pension and social assistance, totaling approximately 600 euros for herself and her child.
