Passaris is left for life – The reasoning of the court

Konstantinos Passaris’s application was rejected (by decision No. 622/2021) of the Supreme Court, requesting the reversal of the convictions against him and the sentences imposed on him by the Athens Joint Jury Court of Appeal (4 times for life and 49 years in prison) for the murders of police officers during his bloody escape from the “General State” hospital in 2001.

In the application, he alleged, inter alia, that his rights had been violated as he had not been transferred from Romania to Greece to appear in court in person and because he had not been given the mitigation of good conduct after the act and the exceeding of the reasonable time of the trial. requested through his lawyer at the hearing.

The decision of the Supreme Court upheld the reasoning of the Athens Joint Jury Court of Appeal that his allegedly good behavior and repentance in prisons was done mainly as a method to then seek mitigation before the Greek courts where the crimes of murder, robbery, etc. were pending against him. particularly large penalties threatened.

It was explicitly stated by the decision that “none of his behavior in the prisons was manifested voluntarily. It was the result of fear and coercion in the harsh prisons of Romania where he had no choice. “His ‘conversion’ to his aunts, which a well-known Archimandrite confirmed in his letter to the court, was not a repentance for the people he killed and the misery he had caused to the relatives of the victims, but an attempt to pretend.”

The same decision explicitly states that the fact that he is pretending, is evident from his refusal, to do the minimum he owed, that is, to give information about his accomplices, who were numerous and dangerous, and about those who supplied him with the weapon in prisons, with which he killed the two police officers and tried to kill the prison officer at the “General State Hospital of Athens” on 16/2/2021.

With the same appeal, he asked “to break the life sentences” because the duration of the criminal proceedings in Greece lasted many years, “without him being guilty”.

What the court ruled

The Court found that he was solely responsible for any delay in these proceedings. Because, after the crimes in Greece, he escaped to Romania, where he committed murders, with the consequence that he was imprisoned for life in the prisons there and that the authorities did not hand him over, until he served his sentence there. With these data, this claim was also rejected and so the life sentences remained for life.

According to the lawyers of the victims of Passaris, Andreas Anagnostakis and Alexis Anagnostakis, “the modest image of the repentant Passaris was his last paper at the end of a long court process. “The real and only victims in this case are the families of the unfortunate people, who have been living in the orphanage of their own people for 20 years, demanding justice and justice with a long delay.”
