He spoke of an “uncontrollable course” which was followed by the vehicle driven by the defendant, stating that the car had undergone technical modifications and its horsepower had multiplied, reaching “perhaps 400 horses”. Speaking in his professional capacity as a “Certified Candidate Driver Examiner”, he commented that the car’s construction could not support such horsepower.
“The child was in pieces,” he noted when asked about Emma’s image when he saw her at the hospital where she was treated. The witness also reported that he had been in contact with his daughter a few minutes before the car accident and they exchanged messages and videos through their mobile phones.
The requests of the defense
Earlier, the defense lawyer for the 27-year-old (who is being prosecuted for dangerous driving resulting in death, as well as for leaving a traffic accident and driving without a license) made two requests to the court: on the one hand, that the expert appointed to do the technical examination should be called to testify in the context of the main investigation and on the other hand, Traffic police officers who first arrived at the scene of the accident and drew up the autopsy report. For these requests, the judges reserved a decision on the course of the trial, which was adjourned until November 29.
The side of the accused argued that the crime of dangerous driving (felony) is not established and that the act committed is that of manslaughter.
The indictment
As described in the indictment, the 27-year-old was not the owner of the fatal car, which had undergone modifications to multiply the horsepower and increase its performance, while the expert opinion showed that it was technically unsafe and dangerous.
It is characteristic that the accused driver allegedly developed excessive speed, which reached 104 km/h, with a speed limit of 50 km/h.
The unfortunate student of the Veterinary School was hospitalized for five days in the ICU of Papageorgiou Hospital where she finally breathed her last. Showing greatness of soul and despite their deep grief, the parents proceeded to donate her organs.
