To be referred to a Joint Jury for manslaughter, which, however, he did in the heat of mental impulse and in excess of the limits of the defense, the prosecutor recommends to the competent Judicial Council, for the 30-year-old who killed a 64-year-old last July, in Menemeni, Thessaloniki. The crime allegedly happened after a fight between them, when the victim attacked the 30-year-old perpetrator, attempting to rape him.

Evaluating the material of the case file, the forensic findings and the defendant’s apology, the prosecutor proposes to the judges of the Thessaloniki Criminal Council to refer him to the Criminal Court for murder, but with mitigating circumstances that, if accepted, will result in a reduced sentence.

The 30-year-old -temporarily detained- invoked the legal defense from the first moment claiming injuries to his face and neck, which were forensically confirmed. According to what he apologized to the investigator, the victim tried to rape him and then he reacted, resulting in a fight. “I went berserk,” he reportedly apologized, trying to justify his actions.

The crime had been uncovered when the accused voluntarily presented himself to the Police, where he confessed to the murder. The 64-year-old was found in a pool of blood inside the studio where he lived with multiple blows to his face and head, while his neck was wrapped with cord. The medical examination “showed” suffocation and head injuries as the cause of death. Three knives were found at the crime scene, while using a sponge, the perpetrator wrote with the blood of the 64-year-old the phrase “Paederasti -1” on the wall.

According to the case file, the 30-year-old had followed the victim to his apartment when he asked him to do some plumbing work.
