The bill aims to simplify and speed up real estate transfer procedures
The bill of the Ministry of Digital Governance was passed: “Acceleration of the procedures for the integration of the Hellenic Land Registry: Processing of outstanding issues in real estate transfers and strengthening of the operational function of the Public Law Legal Entity with the name “Hellenic Land Registry” – Simplification and acceleration of real estate transfer procedures.”
The most basic arrangements concern a series of interventions that reduce bureaucracy, such as:
– the abolition of the obligation to present a certificate of non-payment of TAP (Real Estate Tax),
– the abolition of the multiple presentation of an excerpt of a cadastral diagram (AKD) in case of divided properties of texts within the same parcel of land,
– the submission of exclusively digital copies of notarial acts with a digital summary, without handwritten references, in readable pdf format,
– the attachment of a copy of the cadastral chart by the body itself in case of digital application submission,
– the procedure for correcting obvious errors in cadastral records is simplified with uniform rules, so that the relevant corrections are made at the Cadastre Office and not at the Court,
– issue of not registering in excess of millimeters is resolved. They can now be registered in the cadastral registers, until the composition of the modification of the composition of the property horizon to restore and remove the excess.
Regarding the handling of pending property transfers:
– a Platform for Legal Control of Registrable Deeds is created to carry out remote legal control of applications,
– the accreditation is extended to technical education engineers (after agreement with the TEE), with immediate effect for all accredited engineers without the two-year lapse as has been the case up to now, in order to increase the speed of inspections,
– the extension of the deadline for the correction of first registrations until 30/11/2024 and the provision of the possibility of correcting first registrations in areas where the possibility of disputing an inaccurate registration with the indication “unknown owner” has expired, comes into force, in order to give a last chance declarations before finalization and to address issues in already finalized areas for bona fide owners;
– the operational operation of the Land Registry is strengthened through the establishment of an efficiency bonus for the staff, after the achievement of absolutely measurable goals and with an emphasis on the rapid processing of pending cases,
– at least the 15th salary scale is assigned to the heads of Land Registry Offices and branches as well as deputy heads who have the qualifications of article 18 par. 2 of Law 4512/2018.
