Areios Pagos rejected the application convicted for the second time, due to the killing of animals, with which he requested the annulment of the appeal decision against him.
In particular, on Christmas 2016, he poisoned 3 large dogs, 5 sheep and 1 goat, while 4 years before with “carbamide ester” that he put in food, he killed 2 large dogs and 5 puppies.
For the 2 large dogs and 5 puppies he killed he was sentenced in 2017 to 2 years in prison and for the rest of the animals he poisoned later in 2022, he was given a 16-month prison sentence suspended for three years.
In particular, N.K. has a stable adjacent to that of B.M. breeding both animals, while they often clashed with each other.
In February 2012, N.K. poisoned the neighbor’s dogs with food containing “carbamide ester”, resulting in the death of 2 large dogs and 5 puppies. In 2017, he was found guilty by a three-member Court of Appeal and sentenced to 2 years in prison for killing the 7 dogs.
Then, between December 23, 2016 and February 1, 2017, N.K. poisoned his neighbor’s 3 large dogs, 5 sheep and 1 goat.
According to the decision, the owner of the poisoned animals saw NK’s car, “which is distinctive, as it does not have a spare in the back and has a broken light” and in the seat he saw a figure similar to that of his neighbor, who approached the stable and dropped something. After a while he found a large dog and 3 sheep poisoned. The same scenario was repeated 4 more times, in the next period, until February 1, 2017.
He claimed before the Justice that in the disputed area there are farmers and the animals were poisoned by pesticides which they use on crops, but his claim was not accepted as when the animals were poisoned it was winter season, there were no crops and farmers do not spray their crops with pesticides.
Furthermore, he claimed that during the period (23.12.2016 to 1.2.2017) that his neighbor claims that he nested on his animals, he was with his family in another village to spend the Christmas and New Year holidays
However, this claim was also rejected as on the one hand “as he testified, his wife is bedridden and consequently it is difficult to move her” and on the other hand “he himself had the care of his animals which, even to a third person, he could not to be trusted for such a long time.”
Following these, with regard to the killing of animals in the two years 2016-2017, he was convicted of “consecutive abuse (killing) of animals and continuous manslaughter” and was sentenced to one year and four months in prison, with a three-year suspension, having previously he was given the mitigating circumstance of good behavior after the commission of his act.
He appealed to the Supreme Court asking for the annulment of the judgment against him, as he has misdemeanors and suffers from a lack of specific and detailed reasoning. The areopagites of the 5th Criminal Department rejected his application and all the reasons he put forward, as unfounded.
