The guilt of his uncles for the offense of racially insulting him because of his sexual orientation a Patron, who had constant conflicts and incidents with his relatives, with whom he is also neighbors, requested and received from the Single-Member Misdemeanor Court of Patras.

The case which dates back to 2023 and the court’s decision was published a few days ago on Facebook edited by the lawyer of Patras Christos Tzavaras, shows that the courts of Patras no longer “play” with insults and verbal attacks against people, which have a gender content or concern the their sexual orientation.

The nephew who was represented by the lawyer of Patras, Nikolaos Afaloniatis he complained that he regularly received attacks of this nature from his uncles and neighbors.

In the Single-Member Misdemeanor Court of Patras, it was proven and the court was convinced that both defendants committed the act attributed to them in the indictment, and specifically that “they insulted the honor of the burglar with reason, while this act of theirs carries racist characteristics against the victim because of his sexual orientation”.

According to the court decision, the complainant, returning to his home late at night, from the apartment next door addressed to him the insulting phrases his neighbors and uncles. And the second of the two defendants, said “he is abnormal, he took out the Greek flag and hung this thing (s.s. meaning the flag of the LGBTI+ community), thus manifesting oneism (accusation) and contempt towards the face of the complainant and even with racist characteristics, due to his sexual orientation”.

It was established by the court that the relations between the parties, who happen to be relatives and live in neighboring houses, had been disturbed since 2019, when the defendants were informed about their neighbor’s sexual orientation.

The court was convinced that since then the defendants have been hurling insults at their relative, who happens to be their nephew, because of his sexual identity, as has been recorded in various incidents by the relevant Police Department, as they have had other similar incidents in the past .

In fact, according to his apology, the complainant’s uncle showed an unrepentant attitude, as stated in the court order, as he said his six-year-old granddaughter “will become abnormal, seeing the particular curtains that the complainant had hung.”
