Disciplinary prosecution of vice mayor for hundreds of illegal post-publication decisions asks the competent authorities the National Transparency Authority (NDA) after an audit it carried out in a municipality of Crete.

The audit was carried out by the Rethymno Regional Office of the EAD and related to the first seven months of 2023, a period during which 586 post-referendum requests and the corresponding decisions and 366 requests for certificate of permanent residence and the corresponding certificates.

The audit revealed that 324 certificates were signed by the competent deputy mayor, without to be relevant authorization.

Also, 367 post-municipalization acts were issued on the basis of non-legal supporting documents (certificate of permanent residence of the applicant or spouse), therefore, without meeting the essential conditions for their issuance.

Furthermore, 305 certificates due to two years of residence were issued on the basis of unacceptable or incomplete data and without establishing a real establishment with an element of stability and without justifying the impossibility of proving the status of permanent resident by the required E1 form

Following these, it was requested to start it disciplinary action of the deputy mayor, the revocation of 367 post-municipality decisions and 305 permanent residence certificates as illegal.

Recommendations were also made to the municipality in question to complete the existing applications for a certificate of permanent residence and post-municipalization, to check and record the evidence presented, not to receive formally incomplete files, and finally to ensure that the transfer of responsibilities is compatible with the Organization Internal Service (EOY) and the responsibilities of the Directorate or the Department and the duties of the employees.
