A fine of 30,000 euros was imposed by the Competition Commission on ANEDHK Kritikos for late notification of the acquisition of the company “Associating Grocers”.

In detail, the committee’s announcement states that it met in a section, and decided, following a relevant report by the competent rapporteur, “on the case of late merger notification, regarding the change in control over the company SYNERGAZOMENI PANTOPOLES S.A., from the exclusive control of of the company HELLENIC MARKET S.A. in the exclusive control of the company ANEDIK KRITIKOS S.A.”

The committee recalls that, according to the legislation, any concentration of undertakings must be notified to the Competition Commission within thirty days of the conclusion of the agreement that ensures the control of the undertaking.

As the announcement continues: “The agreement in this case concerns the acquisition of exclusive control by the company ANEDIK KRITIKOS over SYNERGAMENI PANTOPOLES. According to the rationale of the decision, from the available evidence, it appears that the agreement in question was notified to the agency late by 33 days beyond the deadline for timely notification of the concentration.

With decision 823/2023, the Competition Commission finds the late notification of the concentration in violation of article 6 par. 1 of Law 3959/2011, and imposes on ANEDIK KRITIKOS, as liable for notification, a fine of 30,000 euros as provided in the article 6 par. 4 of Law 3959/2011, as applicable. It is noted that the said concentration has been approved by the Competition Commission with the no. 803/2022 its decision”.
