The 4th Department of the Council of State accepted the application of companies that operate in the field of mini bus rental and use uber bv technology and canceled the decision No. 154785/2023 of the Deputy Minister of Infrastructure and Transport, which defines the rules of the total car rental E.I.X. with a driver, through pre-booking and provided for the obligation of those who enter into uber bv contracts to post each route in the digital register, at least 2 hours before its start.

In particular, the contested decision was issued pursuant to law 4093/2012, which allows tourist agencies and car rental agencies to rent a mini bus with a driver through pre-booking of up to 9 seats (including the driver) for a fee.

The owners of these cars are prohibited from looking for customers when they are in traffic or in stopping or parking areas. The specific cars serve the transportation needs in the islands during the summer season except Crete and Evia

In more detail, the 4th Department of the Council of Ministers, chaired by Spyridoula Chrysikopoulou and rapporteur, State Councilor Ourania Nikolarakou, with its decision No. 656/2024, accepted the application for the annulment of the businesses in question and annulled the contested decision.

The SC ruled that the regulation of article 2 paragraph 2 of the contested ministerial decision “has been put in violation of the terms of the authorization of law 4093/2012”.

Furthermore, the SC rejected the intervention of the Panhellenic Federation of Professional Taxi and Market Car Owners, in favor of the validity of the contested decision of the Deputy Minister of Infrastructure and Transport.
