Accountable for disloyalty and moral complicity in disloyalty are eight executives, for the period 2017 – 2018, of the public company GAIA OSE and the companies belonging to the Italian group FSI TRAINOSE (now Hellenic Train) and Hellenic Railway Rolling Stock Maintenance Company S.A. . The category concerns the non-fulfillment of the train maintenance contract as a whole and also the non-collection of rents.

The prosecution against the eight defendants was brought after an order from the Economic Prosecutor’s Office, which carried out a preliminary examination, in the context of the control of contracts concerning the trains and the railway network.

According to the case file, which is already in the hands of the competent Investigator, the part of the case concerning the execution of the train maintenance contract, from the control of the contracts made by the Financial Prosecutor’s Office found that there was no certification of the execution of the project for which 5 .5 million euros. For the disputed contract, the prosecution is directed against the then executives of all three companies involved. It should be noted that ESTY had not been transferred to the Italian group during the disputed period.

The second part of the category concerns damage determined in the amount of 2.5 million euros from the non-collection by GAIA OSE and on behalf of the public, of leases of rolling stock and real estate, by TRAINOSE, through continuous extensions of relevant contracts. Executives of the two companies involved are called to account for this charge. Of the eight defendants, six are being prosecuted for infidelity while two are being prosecuted for moral complicity in infidelity.
