According to information, an inspection of the EYP files was carried out unexpectedly last week by the deputy prosecutor of the Supreme Court, Achilleas Zisis, who is handling the investigation into the case of telephone surveillance, after the complaints of the president of PASOK, Nikos Androulakis, and others.

The deputy prosecutor of the supreme court, who has undertaken the investigation of the case, according to information, went to the EYP accompanied by two special experts, from the list available to the Court of First Instance of Athens.

Checking her records National Intelligence Servicewas carried out in order to establish whether there was monitoring by the EYP of those persons who received a message (sms) with the aim of installing the illegal pretador software for their monitoring.

The confirmation or non-existence of monitoring by the EYP of the persons who make up the so-called “pretador list”, the “Menoudakou list” as it is usually called from the investigation carried out by the Personal Data Protection Authority (chaired by the honorary president of the CoE, Konstantinos Menoudakos), is the most crucial element of the investigation into the wiretapping case.

If from the surprise control of Mr. Zisis, evidence was found, something that was not made known, confirming that some or all of those on the “Menoudakou list” were also monitored by the EYP, the investigation of the case takes a new turn.

However, the deputy prosecutor of the Supreme Court, according to the same information, himself went to the EYP, in order to cross-check the list in question, since at an earlier stage of the investigation (when it was in the hands of the first court prosecutors) any attempt had been made to the ADAE but and to the three-member body provided by the current law did not yield. It is noted here that with the law 5002 of 2022 which had caused strong reactions and different legal approaches, it was foreseen that the ADAE is no longer competent to satisfy, under the conditions set by this law, requests from citizens who ask to be informed if they have been monitored . Instead of the ADAE, this law provides for this competence a three-member body consisting of two prosecutors and the president of the ADAE.

Finally, it should be noted that regarding the provisions of this law (5002 of 2022) the much-discussed opinion of the then Supreme Court Prosecutor Isidoros Dogiakos was issued.

Finally, it should be noted that the Zisi investigation is nearing its end, as information indicates that dozens of witnesses have already been examined and requests for judicial assistance sent to various foreign authorities, including the USA, have been answered.
