An appeal against the decision of the Mixed Jury Court that acquitted the two brothers accused of being the perpetrators of the cold-blooded murder of journalist Giorgos Karaivaz, is requested by the Appellate Prosecutor’s Office, at the request of the victim’s mother and sister.

The lawyers of the two women, Roi Pavlea, Spyros Haritatos and Antonios Xylorgidis, submitted to the Appellate Prosecutor’s Office a request for the case to be decided by the Court of Appeal, considering that the first-instance court did not sufficiently evaluate the material of the case file against the two alleged natural perpetrators of the murder case . The advocates of the journalist’s mother and sister state that the appeal is necessary as they believe that the MOD erred in the acquittal decision it issued some time ago, did not evaluate or incorrectly evaluated rich evidence and did not justify its judgment. They emphasize that the Prosecutor of the MOD Headquarters had proposed that the two defendants be sentenced in her appeal.

In the application to the Appellate Prosecutor’s Office, it is pointed out, among other things, that the two brothers were identified by eyewitnesses as the perpetrators of the attack, while the police officers who examined the video footage and the witness driver who saw them violate the stop, testified that the 2 defendants match the perpetrators.

In their statement, two of the advocates, Roi Pavleas and Spyros Haritatos, state: “We filed an application for an appeal against the no. 1328/31-07-2024 decision of the Mixed Jury Court of Athens on behalf of Giorgos Karaivaz’s mother Panagiotas Karaivaz and his sister Anatoli (Litsa) Karaivaz because they, like us, were convinced of the defendants’ guilt. Any guilt was firmly established by the testimony of the eyewitnesses, the false alibi of the defendants as well as the false testimony of the defense witnesses. But an incorrect assessment of the evidence was made and a decision was taken without sufficient and detailed reasoning which suffers from internal contradictions.

We therefore requested that an appeal be filed against the no. 1328/2024 of the decision of the Athens Magistrate’s Court and that the case be re-tried and investigated in depth by the Mixed Jury Court of Appeal of Athens and that the defendants be sentenced to the appropriate penalty for the acts of homicide with intent to complicity as well as illegal carrying and use of weapons. Giorgos Karaivaz was murdered because he was steadfastly non-integral and non-negotiable. He was murdered because he was a Journalist to the core».
