The court found him guilty of the specific act, while with the same decision imposed on the defendant the condition of not approaching his wife, at a distance of less than 50 meters.
According to the case file, the priest in a rage “threw the minced meat from the balcony” and acted threateningly against the complainant, because she made a fuss while cooking in the evening. During the same complaint, the 60-year-old raised his fist demanding that he stop cooking.
Testifying in court and describing the disputed incident, the elder said she had returned from work, as she works “seasonally”, and started cooking. “My husband got upset and told me that I am making a fuss because it is night. There was tension. I continued because I wanted to prepare the food. He threw the mince in the trash and moved menacingly towards me. I felt threatened, he left the room and I took my bag and went downstairs. I called the patrol car to make introductions to him,” she said, adding that after the particular incident the 60-year-old left the house and she started the process for them to divorce.
She testified that this is not the first time she has reported her husband for a domestic incident, as last year in August she had contacted the police again when “he pulled me by the hands, threatening to kill me and hang me”, as she testified to the policemen. Attempting to play down the incident, he has now told the court that it was a fight “as happens with all couples”.
To the persistent question of the court about whether the 60-year-old has exercised physical violence against her, the 48-year-old, after a long pause, answered “no”. Testifying as an eyewitness, the couple’s daughter denied her mother and emphasized that she “never has a habit of inventing things”.
In his apology, the priest claimed, among other things, the following: “In all couples there are disagreements but ours is not remarkable, maybe she takes it that way. She wants it to be hers. That night I begged her not to cook. I took the mince and put it in the fridge and she put it back on the counter. Last time she said I grabbed her hands hard but it didn’t happen that way.”
The prosecutor of the seat had also requested his guilt, saying that the complainant felt terror and concern, while commenting on her testimony in court, she observed that “it took place under a regime of fear”.
