In implementation of the court decisions 39/2024 and 40/2024 of the Multi-Member Court of First Instance of Kavala, the first eradication of illegal grape cultivation of the PRISTINE variety took place.

These are decisions, stations, as with them the SWEETA and PRISTINE grape varieties are now protected by the Judicial Authorities.

Specifically, with the decisions 39/2024 and 40/2024 of the Multi-Member Court of First Instance of Kavala, which were issued following a lawsuit brought by the company “LURIBAY BUSINESS Inc”, the purchase, production, packaging, storage, handling, sale and any kind of disposal by the defendants of the protected plant variety of BLANC SEEDLESS grape (Vitis L.) with the code “ACS V 01”, (known by the trade names SWEETA and PRISTINE), exclusive beneficiary of which for the territory of the E.U. is the company in question.

In fact, as mentioned in the decision, the defendants are obliged to proceed with the immediate eradication of the vine plants of the protected variety “ACS V 01” from the disputed lands. It was also ordered that the uprooting be done at the expense of the defendant within 10 days of the notification of the decision to him and that the uprooted plants be delivered to the plaintiff company.

This is a landmark development, as in addition to the protection of the variety in question, it will act as a deterrent to the illegal practices of trafficking, planting and marketing of varieties with exclusive rights.
