The Plenary Session of the CoE blocked the expansion of the port of Piraeus

Its Plenary Session Council of State canceled the approval framework of the Master Plan (General Program Plan) of the “Piraeus Port Authority (PPA) SA”, for the mandatory investments arising from the concession contract of the port of Piraeus (2016) to Cosco Group Limited and which provided, including the extension of the passenger compartment port of Piraeusnew passenger station, etc.

Specifically, were canceled the acts of the Port Planning and Development Committee, which had approved, in the context of the approval of the PPA Master Plan, the mandatory investments, based on the concession agreement to Cosco, concluded between the Greek State and PPA SA. and was ratified by law 4404/2016, as well as the additional investments of the PPA in the port of Piraeus.

In particular, the Plenary Session of the CoC with its decisions No. 547-548 / 2022 (chaired by Mary Sharp and rapporteur State Counselor Maria Sotiropoulou) ruled that:

a) Approval acts were illegal, because it had not preceded, in violation of Directive 2001/42 / EC and the joint ministerial decision of the Ministry of Environment, Physical Planning and Public Works. 107017 / 28.8.2006, strategic environmental assessment of the new design of the port of Piraeus, which included, inter alia, the southern extension of the passenger port of Piraeus, a new land passenger station, four new hotel complexes, the extension of the cargo station to the commercial Port of Heraklion and the construction of a five-storey car parking building at the Pier of Heraklion and new warehouses in an area of ​​80 acres (seven members of the court voted in the minority) and

2) Canceled the act of the Secretary General of Ports, Port Policy and Maritime Investments of the Ministry of Shipping and Island Policy, which granted the construction permit for the project of the southern extension of the passenger port of Piraeus.
