The Court imposed a suspended sentence of 3 years on each of them, finding them guilty of the misdemeanor of grievous bodily harm – on conversion of the charge from grievous bodily harm (felony), while additionally recognizing the mitigating factor of post-adolescent age.
The incident was attributed to the bad timing by the two defendants, who, apologizing, acknowledged that they were wrong and asked for forgiveness. They emphasized that when they realized the seriousness of the situation, they tried to offer the victim first aid. “I thought he was mocking me, I was wrong“, the 25-year-old musician said, among other things.
According to the summons, the 23-year-old was with two of his friends in a bar on Syngrou Street, when, recognizing the trapper, he approached him and addressed him with the phrase “you are famous”. Then the trapper, according to the indictment, called him to him and replied “what did you say, I’m famous”, suddenly hitting him with his face on the head (kutulia). The student jerked, taking one or two steps back and before he could react, the 24-year-old friend of the trapper kicked him hard in the chest, as a result of which the sufferer fell down and hit the back of the head, losing consciousness for a few minutes. .
Almost 24 hours later, when his friends became concerned about his health, they took him to the AHEPA hospital, where doctors found that he had brain injuries and hematomas, for the removal of which he underwent surgery, and was then hospitalized in the ICU, being discharged after several days of hospitalization.
“After a long surgery, my child was in the ICU for 15 days. Fifteen days we were alive and dead. My son will be disfigured for life and on special medication. He will never have normalcy in his life again without medication.” among others, the 23-year-old’s mother stated in court, testifying as a witness. For his part, the student’s friend who was an eyewitness to the incident testified that the 23-year-old “didn’t do anything, didn’t provoke, or mock”.
