Last May the Authority had imposed fines on the interior ministry of 400,000 euros, Anna – Michel Asimakopoulou 40,000 euros
The annulment of the Major Plenary of the Council of State was discussed to annul the decision of the Authority of Personal Data on which fines were imposed on the distribution of e-mail Greeks abroad in view of the June 2024 European elections (letter vote).
Last May the Authority had imposed fines on the interior ministry of 400,000 euros, Anna – Michel Asimakopoulou 40,000 euros, New Democracy 40,000 euros and from 10,000 euros to the former Organizing Secretary of Self -Government and Crisis Management ND, Nikolaos Theodoropoulos.
During the hearing in the Supreme Court of Appeal, all those involved developed their allegations.
Mrs Asimakopoulou’s side stated that on the occasion of the fine imposed by the Authority, -which, he said, did not allow her to exercise the right to hear so that she could prove that her origin was legal List of expatriates- about 200 recipients of e-mails have filed lawsuits for violations of their personal data and claim a total of 4 million euros.
In addition, he pointed out that there was a legislative gap, as a European Directive has not been ratified by our country, which enables the use of similar lists.
ND
The ND said that the list of expatriates was not moved to the party’s information systems, that he did not order, had no involvement and could not know that there was an illegal record.
The position of party executives
The side of Nikolaos Theodoropoulos argued that he was integrated into the party line and, by command, conveyed the file to Mrs. Asimakopoulou without any processing or intervention, while claiming that he was mistakenly described as a controller, as he was just a manager.
Aristodemus Koromila’s lawyer described the client of the “Musting”, who did not know the contents of the file, while noting that he was not responsible for the file and did not process it.
The nine lawyer argued that his clients are victims of personal data breach, as they were handled by their personal data and without even knowing who was sent.
The CoE’s decision is expected in the coming months.
