The sentence of 15 years imprisonment, with the recognition of the mitigation of his legal life, was imposed by the Mixed Jury Court of Appeal (MOE) of Thessaloniki to the 33-year-old cooler who killed his 63-year-old client with a hammer, in June 2019, in Kalamaria, Thessaloniki, when he broke out the maintenance of its air conditioner.
The Court upheld the decision at first instance, against which an appeal had been lodged by a prosecutor, considering that he had been wrongly granted the mitigation of legal life.
Judges and jurors of the MOE, however, unanimously ruled that he should be granted, while a relevant proposal for granting a mitigating circumstance was made by the prosecutor of the headquarters.
According to the indictment, the young refrigerant, citing workload, refused to perform any additional work requested by the 63-year-old, a fact that seems to have displeased her.
A fight ensued with pushing from both sides in the corridor of the apartment, and then, as described in the indictment, the 33-year-old snatched a hammer from his toolbox and hit the unfortunate woman several times in the head, resulting in her fatal injury.
“I was confused when he insulted my mother,” the defendant said in his apology, a claim he had made in the previous court.
After the verdict of the judges, he returned to the prisons of Patras to serve his sentence.
