The criminal omissions that led to the death of the 19 -year -old, last August, in the Amusement Park of Halkidiki, are described by the multi -page parliament of the Polygyros Criminal Council, which are brought to trial, before the Joint Circuit Court of Justice.
In the parliamentary number of more than 100 pages, judges (by a majority 2-1) reject the prosecutor’s proposal to convert the act into a deadly report, and decide to trial the owner of the amusement park, his wife (as co-operator) and his co-operator In an attempt, co -conspiracy and in the face, while their co -defendant mechanical engineer who had provided certificates of control of the game machine for simple complicity in practice.
The parliament reportedly states that the Crazy Dance was a staple and assembly of individual components and sections without a technical envelope and manufacturer data, but also in general without a manufacturer or safety model. It also lists a total of ten failures – structural, mechanical and electrical – as emerged from the expertise conducted during the preliminary examination stage.
Omissions
In addition to its inadequacy, 6 omissions are described to Crazy Dance’s operation and security terms and which relate to the following:
– Non-replacement of the metal structures of the wheelchair due to extensive erosion, both internally and externally, which had been suffered that could be detected by macroscopically “naked eye” in a visual control
– No care was taken to have a speed regulator (cutter) in order to automatically reduce speed in the event of exceeding the permitted limit, as was the case in this case
– No clear biometric boundaries for users, based on its status
– inappropriate training of the operator
– Non -audit during initial technical inspection by a recognized control body to obtain a type approval certificate
– No testing or visual inspection was carried out by certified staff and where required, by licensed staff whose technical competence is determined under legislation.
Ruled Crazy Dance voluntarily
With the same Member, it is decided to extend the temporary detention for the 59 -year -old accused owner and the maintenance of the restrictive conditions by which the remaining three were released.
For the first, reports indicate that after the opening of the amusement park, (at a request to the Municipality of Kassandra), he voluntarily destroyed the entertainment machine in question, and then applied to the investigator Polygyros to declare his report.
These actions appear to have been intended to eliminate evidence in order to make it impossible to further use them through investigating (and not only) acts, according to judicial sources.
