Στε: The reduction of parking spaces in Elliniko is legal

The draft Presidential Decree was deemed legal by the Council of State, which reduces parking spaces at the Metropolitan Pole of Elliniko – Agios Kosmas.

A draft PD was submitted to the SC for elaboration for the “revision of 28-2-2018 PD. “approval of the Integrated Development Plan (SOP) of the Metropolitan Pole of Elliniko – Agios Kosmas of Attica” “.

The 5th Department of the CoC, chaired by the vice-president Margarita Gortzolidou and the rapporteur Theodora Ziamou, with its opinion No. 53/2022, considered the draft PD legal, while making some remarks.

According to the draft PD, the regulations in question are intended “in increasing use of Public Transport in land uses and poles of attraction of a significant number of movements, mainly workers, such as the Metropolitan Pole of Elliniko – Agios Kosmas, through the application of consolidated international practices and experiences in relation to parking policies “and from a legal point of view, the regulations in question proposed “as the first application of the principle of sustainable mobility”.

According to the draft PD, the revision of the SOA concerns the number of parking spaces for each building use, except the residence in the area of ​​the Metropolitan Pole Elliniko.

According to the explanatory memorandum accompanying the draft PD, the proposed amendment intends to apply, first, in the area of ​​the Metropolitan Pole Elliniko – Agios Kosmas, to apply the provisions of the latest environmental law 4685/2020 and especially the one provided “The possibility of determining the number of required parking spaces, in all areas covered by Local and Special Spatial Plans, SOA, ESCHASE and ESCHADA, for each planned building use and in derogation of the provisions of Presidential Decree 111/2004, if it is established that The property is served by means of a fixed orbit within a radius of 500 meters from the station of these means and the attempted regulation is duly justified by the required traffic study “.

The proposed rates for reducing the number of parking spaces vary by percentage based on the following components accordingly: 1) Whether it is a use served by a metro station, which shows, comparatively, a better level of service or a tram stop, which is characterized by low passenger traffic and reduced frequency of services in relation to the metro and 2) With the radial distance of uses from a metro station or tram stop.

As stated in the PD plan “for uses, which are up to 500 meters from the metro station, parking spaces are reduced by 60%. For uses that are: up to 300 meters from the tram stop, parking spaces are reduced by 30%, while from 301 meters up to 450 meters from the tram stop, parking spaces are reduced by 20% and from 451 meters up to “500 meters from the tram stop, the parking spaces are reduced by 15%”.
