Mônica Bergamo: Action asks for R$ 1 million from Ibama and automakers because of more polluting cars

The automakers Toyota, Nissan and Renault and Ibama (Brazilian Institute for the Environment and Renewable Natural Resources) are the targets of a lawsuit in the Federal Court of the 3rd Region asking for R$ 1 million in compensation for environmental damages.

At the heart of the dispute, brought by the Institute of Health and Sustainability, is a December 2021 standard published by Ibama. The agency gave in to requests from automakers and extended, by three months, the deadline for adapting to a new stage of environmental legislation.

Until then, the Vehicle Emissions Control Program predicted that light cars produced from January 1 this year should emit less pollutants than models made in 2021. The list of harmful substances includes carbon monoxide and soot, for example.

With incomplete cars due to lack of parts, manufacturers said they run the risk of not completing models already started in time of the standard.

Sought, Toyota says that it adapted its vehicles within the original deadline and that this was its plan from the beginning. Nissan, in turn, says that all of its products comply with the legislation and that it will not comment until it has details about the action. Renault says it has not been notified and will not comment until it becomes aware.

The Institute of Health and Sustainability, which advises the Federal Public Ministry (MPF), also claims that IBAMA took just 30 hours to edit the regulation after receiving a request from the Ministry of Economy — suggesting that there was no in-depth analysis of its effects. .

“The motivation adopted by IBAMA is the result of merely marketing positions, more precisely, of desires of the automobile sector”, says the entity. The lawsuit also states that the measure does not bring benefits to the environment, as would be expected from IBAMA, but harms the environmental quality and the health of the population. And he points out that, with it, “tens of thousands of more polluting vehicles” will circulate for years to come.
