The Land Registry has launched a 20-day information campaign in Crete for the declaration of ownership

by

Started, on Monday 16 May 2022, the 20-day information campaign in Cretewhich includes tweekly excursions to areas of Rethymno, Heraklion and Chaniawhere the collection of statements is in progress, from the Hellenic Cadastre branch headed by the General Director, Stefanos Kotsolis, the Director of Cadastral Projects, Aria Ioannidis and other scientific executives.

Following the meeting with the MPs of Crete that took place last week at the Ministry of Digital Government, the team visited the Governor of Crete Stavros Arnaoutakis.

During the visit to the Regional Unit of Rethymnon, the representatives of the Land Registry met with the mayors and deputy mayors of the Regional Unit of Rethymnon (Rethymno, Agios Vassilios, Amari, Anogia)while earlier they talked with the administration of the Rethymnon Bar Association and, subsequently, with the Directorate of Forests, the Real Estate Service and the Department of Land Improvements.

The cadastre team has met and will meet in the coming weeks with institutions and trade unions, such as the Municipalities and their technical services, the bar associations, the notaries, the Technical Chamber, as well as with all the professionals involved in the subject and with government services.

The main purpose of the visits and the information campaign is the mobilization of the owners in Rethymno, Heraklion and Chaniaas after several months from the start of the collection, the low attendance concerns the officials of the Land Registry and the assistance of the local authorities is very important for the activation of the citizens.

At the same time, the contacts include discussions on issues related to the declaration of ownership of each Municipality and state services, as well as more specific property issues of each area.

The General Director of the Hellenic Land Registry, Stefanos Kotsolis, speaking to representatives of the Cretan media, referred to the peculiarities of Crete, wanting to awaken those who remain skeptical or simply oligarchy.

“Last week we started a meeting at the Ministry of Digital Government with all the deputies of the island and then we visited the Regional Governor and all the bodies of Rethymnon.

We have three cycles of information: the first one started on Monday, May 16th and concerns Rethymno. Next Monday, May 23, we will visit Heraklion for three days, followed by Chania on May 30.

We try to mobilize them all. Because the message is one: a statement, however incomplete, even bad, is better than no statement at all in securing citizens’ rights. All citizens must understand that it is in their interest to make statements now.

The peculiarities of Crete, which have to do with usufructs, pastures, etc. created suspensions and phobias in the citizens, while, perhaps, someone thought that “since it has been mine for so many years, who will challenge it?”

Another deterrent is that citizens may find this process too costly as it has to be done with precision surveying etc. The truth is that citizens can declare without accurate topography. After all, all the problems and shortcomings will be seen in the pre-post in order to be corrected in the post “.

The deadline for the collection of property declarations, after the extended extensions that have been given, expires on June 30, 2022.

Every property owner has to participate in this process, by which he finally clarifies “who owns what”, and to record, delimit and secure, in the end, his rights, even those that are not transferred to the mortgage office. , such as usufructs and legacies.

At the Registry Offices of each area, experienced engineers and lawyers provide free information and support services for the submission of declarations and the location of real estate, while the declarations are also submitted electronically.

The timely submission of the declaration serves the interests of the beneficiaries themselves, since it is known that the consequences of non-submission of the declaration are the prohibition of any legal act (parental benefit, sale, etc.) on the property for the undeclared and non-declared right. granting a building permit, while after the posting of the data resulting from the collection of declarations, the process of recognizing an undeclared right becomes complicated and at an additional cost.

After the first registrations in the land registry, time-consuming and costly procedures are required for the recognition of the undeclared right, while if a property is not declared, after some years, it falls into the ownership of the Greek State, if no lawsuit is filed.

Apart from these consequences, however, the imposition of a fine is provided, depending on the type and value of the property, which (imposition of a fine) can be activated at a later stage.
