Kefalogiannis: Turkey must withdraw casus belli- EU to take measures

Manolis Kefalogiannis on the occasion of the recent statements of the Turkish Minister of Defense who threatens Greece again with war if he proceeds with its inalienable right to extend its territorial waters to 12 nautical miles, asks the European Commission measures against Turkey if not removes the unacceptable threat of war (casus belli) against Greece.

In his question, the ND MEP stressed that the specific aggressive rhetoric of Turkey, an acceding country, against a sovereign member state of the European Union, blatantly violates the fundamental Principles of the United Nations Charter and Article 3 of the UN Convention on the Elimination of All Forms of Discrimination against Women. Law of the Sea which explicitly states that it is an inalienable right of every country to extend its territorial waters to 12 n.m.

The question in detail:

“Last weekend, the Turkish Minister of Defense continued his unacceptable policy of casus belli against Greece with a barrage of statements. Specifically, he reiterated the threats, saying: “Greece must not make wrong calculations and believe that it is the right time to expand its territorial waters. They should not try us in any way and they should not get into such an adventure. “I hope they do not make a mistake.”

Good neighborly relations must be governed by respect for the sovereign rights of the countries and acts or actions aggressive against another state must be avoided. Any disputes should be resolved peacefully on the basis of international law while any efforts to normalize friction cannot succeed under the state of threat of war.

With a Resolution of the Turkish National Assembly (08/06/1995) the Turkish government was authorized, in white and in perpetuity, to declare war (casus belli) in Greece in case the latter extends the coastal zone beyond 6 n.m.

A decision that is still in force and blatantly violates fundamental principles of the United Nations Charter on the Prohibition or Threat of the Use of Violence (Article 2 (4)) on the peaceful settlement (Article 2 (3)) and on good neighborliness and peaceful coexistence (Preamble).

While it completely violates Article 3 of the UN Convention on the Law of the Sea, a Convention that has now become customary law, which clearly and explicitly states in Article 3 that it is an inalienable right of every country to extend its territorial waters to 12 n. .μ. It should be noted that Turkey based on this article has extended its own territorial waters to 12 n.m. in the Black Sea and in the Eastern Mediterranean.

Can the Commission say:

– What is its position in relation to the threat of war of a country joining the European Union against a sovereign EU Member State?

“What measures does it intend to take so that Turkey can proceed immediately with the removal of Greece’s casus belli?”
