The Hague Convention for the International Protection of Disabled Adults to be ratified in Parliament

Filed in Parliament the law plan of the Ministry of Justice for the “ratification of the Hague Convention of 13 January 2000 on international protection of adults». This Convention for the international protection of adults has been endorsed by Greece and its ratification is pending, so that it can enter into force in our country as well. It follows the general structure of the Convention of 19 October 1996 for the protection of children (which has already been ratified by Greece with Law 4020/2011).

THE Contract concerns adults who, due to deterioration or inadequacy of their personal abilities, are unable to manage their own property or personal affairs and therefore need protection.

This Convention applies in particular to cases in which vulnerable, in the above sense, adults are in a state other than that of their nationality.

This Convention, which is structured in seven chapters, defines the conditions for its application, international jurisdiction, applicable law, the status of recognition and enforcement of judgments, the establishment of cooperation between the authorities of the Contracting States, while in the last two chapters of the Convention general and final provisions are included.

In particular, the objectives of the Convention are the folowing:

– The effective protection of vulnerable adults in international situations.

– The safeguarding of the personal and property interests of the adult and the respect of his dignity and autonomy, by establishing a secure legal framework.

Facilitate the provision of judicial protection and representation of vulnerable adults.

– Enhancing population mobility between European States (in the context of the expressed need at EU level to strengthen the protection of vulnerable adults)

– Avoiding conflicts between the legal systems of the signatory States in matters relating to jurisdiction, applicable law, recognition and enforcement of adult protection measures.

Promoting international cooperation for the protection of vulnerable adults.
