Caboclo seeks to replace Colonel Nunes as president of the CBF

The president removed from the CBF (Brazilian Football Confederation), Rogério Caboclo, seeks vice president Antônio Carlos Nunes de Lima, Colonel Nunes, to assume again the top position in the entity on an interim basis.

For Nunes to occupy the post until March 2023, they use as a basis an article of the confederation’s own statute.

Caboclo, removed due to accusations of sexual and moral harassment made by his former secretary, resorted to Article 61. This states that “the vice-president appointed by him shall replace the president, in the event of absence, leave or impediment “.

If Nunes takes office, Caboclo believes it will be easier for him to regain the organisation’s top post, after being removed from it in June this year.

A sheet had access to the minutes of the 15th Notary Office of Rio de Janeiro, in which the notary public details how she reported to CBF, at its headquarters in Barra da Tijuca, about Caboclo’s manifestation.

If the interim president of the confederation, Ednaldo Rodrigues, ignores the document, the lawyers of the absentee must turn to the CBMA (Brazilian Center for Mediation and Arbitration), which works as an arbitration chamber chosen by entities to resolve commercial and electoral conflicts.

The petition is signed jointly by Caboclo and Nunes. The deputy came to chair the CBF after Caboclo’s departure, in June, but since August, after a decision by the Board of Directors (formed by the eight vice-presidents), who is in charge of the entity is the Bahian Ednaldo Rodrigues.

More than two months later, Caboclo and Nunes say that the Board of Directors did not have permission to elect Rodrigues. The pair also evokes article 73, which defines that the council, composed of the president and vice presidents of the CBF, is only responsible for deciding on the board’s deliberations, strategic plans and general policies of the entity.

When contacted, the CBF said that interim president Ednaldo Rodrigues “continues to exercise his functions normally” and that Caboclo “is prohibited from participating in any activity related to football for 21 months, by decision of the Brazilian Football Ethics Committee, unanimously endorsed by the General Assembly, formed by the 27 State Football Federations, a decision accepted by FIFA and extended to the world scope.”

On September 29, the presidents of the federations decided that Caboclo should be removed from the presidency of the CBF for that period.

With the punishment, discounting the time already served since the beginning of his leave, in June of this year, Caboclo will return in March 2023, one month ahead of the scheduled for the end of his term.

The removed manager will likely not have a chance to run for re-election. The next election may be called from April 2022, during which time he will be ineligible.

Caboclo had been away from the organization’s Ethics Committee since June 6, after being accused by his secretary of moral and sexual harassment. The complaint was filed two days before.

On the same weekend as he left, Fantástico, on TV Globo, aired a dialogue between the top hat and the employee, in which it is possible to hear him questioning whether she was masturbating and having a romance with another CBF colleague.

The complainant also said, in a report presented to the Ethics Committee, that the agent would have offered her a dog biscuit and called her a bitch.

The 21-month penalty concerns only the secretary’s complaints. There are two other charges of sexual harassment and one of moral harassment made by a director of the entity that are still being investigated by the Ethics Committee.

Caboclo says he has been the target of actions orchestrated by Marco Polo Del Nero, his predecessor, who left the CBF accused of corruption in the case called Fifagate. Caboclo’s defense denies that he committed moral and sexual harassment.

Reserve colonel of the Military Police of Pará, Nunes held the most important position in Brazilian football from February 2017 to April 2019. Before that, he had already spent 150 days in the role, in 2016, when Del Nero graduated after being indicted by United States Justice.

Throughout his two provisional terms, Nunes was appointed as the representative of the interests of the group led by Del Nero.
