It is striking, however, that the sports judge does not adequately explain her reasoning for imposing only a fine and not a 2 to 4 home penalty, despite the fact that she explicitly states that the Mars fans at gates 31 and 32 caused extensive damage to foreign property.

This article, which provides for a sentence if the incidents are accompanied by damage to foreign property, adds that “in the event that the incidents took place exclusively in the surrounding area of ​​the stadium, or were small-scale and did not cause bodily harm to any person, then no penalty will be imposed for matches without spectators».

It does not explain, however, why it takes into account this addition and does not impose seat penalties, rather than simply saying that he took into account “all the circumstances of time and place, the means used to carry out the acts, as well as their gravity, the nature and type of the disciplinary violations, but also the type and degree of fault of the disciplinary controls».

«From all the evidence it proves, first of all, that at the beginning of the match, at 23 ‘minute, at half time and at 68’ minute of the match, fans of the visiting team (PAE ARIS), who had tickets and who were at Gates 25 and 27, the abusive slogans were uttered: “ACHILLEA GA …… I Μ SOU”, “BEO B… POU… .. (…) It turns out that in the 10th minute of the match, about 300 fans with insignia of the accused PAE ARIS gathered on the first footbridge, in order to enter the stadium without tickets. After they did not get involved with the police, as a result of which chemicals were used, the above-mentioned fans broke the police cordon and, after jumping over the railings of the external fence, entered Gate 12. Then, it turns out that the above 300 fans moved to the VIP Gate, where they got involved with the fans there, before finally being transferred to Gates 31 and 32, without however joining them with the other fans already at Gates 25 and 27 of the host PAE ARIS, who had tickets and who did not reunite with the aforementioned approximately 300 fans of the guest, nor were they involved in the episodes, which took place in the above place at the VIP Gate.

After the end of the match, fans of the accused PAE ARIS, who had not been provided with tickets, during their departure, broke at least thirty (30) seats at Gates 31 and 32.

(…) The claim of the guest PAE ARIS, that all the fans in the stadium had purchased all their tickets, does not prove to be valid, since, as confirmed by both the observer’s report and the police report, the specific fans did not they had tickets and, for that reason, they broke the police cordon and jumped over the railings of this outer fence, in order to enter the stadium.
