The European Commission with Executive Decision (EU) 2025/1760 of 19 August 2025 which was published in the Journal of the European Union (OJ L, 2025/1760, 01-09-2025), imposed the measure of withdrawal of mobile phone by name iPhone 12 A2403manufactured by Apple Inc.

This decision was based on tests and controls carried out by the competent French Authority for the Supervision of the Radio Equipment Market (Agence nationale des fréquences-ANFR) on the specific product, states a notice from the National Commission for Telecommunications and Posts (EETT).

According to the announcement of the French Authority (No. 2014/53/EU-F-231005-14771), it was found that the product does not comply with the requirements of Directive 2014/53/EU regarding the health and safety of persons and of pets (Article 3.1.a). In particular, laboratory measurements showed that the device emits higher levels of electromagnetic radiation from the prescribed safety limits, which means that the exposure of users to radio frequency fields may exceed the permissible limits for the general population.

Accordingly, it was imposed measure of withdrawal of the product from French market.

Within the prescribed period of three months it was submitted objection from the Irish Supervisory Authority (Commission for Communications Regulation-ComReg), as a result of which the European Commission was called upon to decide, in accordance with Article 41 of Directive 2014/53/EU, whether the measure taken by ANFR was justified.

Based on the decision of the European Commission, which was published in the Official Journal of the European Union (OJEU), the withdrawal measure taken by ANFR is considered justified and also applies to the Greek marketin accordance with Article 41 of PD 98/2017, (Government Gazette 139/A/20-09-2017).

In continuation of the above, the financial institutions that have the Greek market the mobile phone iPhone 12 A2403 of Apple Inc., must immediately proceed with the necessary procedures for its withdrawal, informing EETT of their actions. Withdrawal in this particular case means any measure aimed at preventing the availability of the particular type of mobile phone on the market.
