Embarrassed attorney Michael Avenato has been sentenced to four years in prison for stealing the book from his porn star manager, Storm Daniels, during a court battle with former President Donald Trump.
A California attorney was sentenced to four years in prison in federal court in Manhattan on Thursday. Since he is currently in custody, he will spend another two and a half years in prison on top of the two and a half years he already served for another fraud conviction.
Judge Jesse M. Furman said Avenati’s crime was “desperate” when his law firm was struggling. He said that he would “send a message to the lawyer” about the consequences of the wrong decision.
Avenati was convicted of wire fraud and identity theft for stealing about $300,000 from Daniels, who was supposed to get it in connection with the book deal.
“It’s been three years since Avenati found out what he did and he was devastated,” said Clark Brewster, Daniels’ current attorney. Daniels was not in court.
“It was common for this guy to be a good lawyer, but there are questions about his legal scholarship based on the case we received. It was a deceitful plan. This is not an error. It was calculated,” he added.
In the sentencing memorandum, the prosecutor noted how Avenati stole from his client while presenting himself to the world as his champion and defender.
“Avenati stole from his client. He did it to help his own business and finance his own lifestyle. He presented himself to the world as a champion and advocate for the client. Despite presenting and using this fictitious credibility to ensure his popularity and exert political influence, he did.” And he exercised his trust and authority as a lawyer and he. We did this by forging the client’s signature and lying to his client and others over and over again for months,” the attorney said.
Avenati briefly cried when he told the judge he would be known as a “disgraceful lawyer” forever.
