Explaining the view of the current majority of the Supreme Court, the judge Samuel Alito argued that “the rationale (for the 1973 decision) was extremely weak, and the decision had disastrous consequences. “And instead of bringing about a national settlement on the issue of abortion, it has sparked debate and deepened divisions.”
Judges Steven Breyer, Sonia Sotomayor and Elena Kagan, who were in the minority, strongly criticized the majority, stressing: ““We regret this Court – but more so the millions of American women who have lost their fundamental constitutional protection today.”
