Russia: Criminal prosecutions for refusal to draft have begun

A 32-year-old man who refused to sign the marching sheet collected by the special forces has been kept in solitary confinement for two twenty-four hours already.

In the city of Penza, the first criminal prosecution was brought for refusal of conscription (based on Article 328 of the Criminal Code), announced the head of the human rights defense organization “Agora”, Pavel Chikov.

According to Chikov, the person prosecuted is a 32-year-old man who refused to sign the marching sheet at the enlistment office for conscription, as a result of which he was arrested by the special forces and sent to solitary confinement where he has already been held for two twenty-four hours.

The case is being investigated by the local department of the Investigative Committee of Russia. Today, the investigator is expected to refer the case to justice to decide the sentence that will be imposed on him.

According to Article 328 the maximum penalty for refusing to enlist in the army is two years in prison.

Chikov clarifies that those who avoid conscription cannot be prosecuted under this article. “The issue is that according to the clarifications of the Supreme Court of the Russian Federation, Article 328 of the Criminal Code of the Russian Federation applies only to citizens who avoid conscription for their mandatory military service (point 2 of the Plenary Decision)” said Chikov.

The lawyer for the alleged draft evader requested that the prosecution against him be dropped.
