The presidential immunity of the former President of the United States of America, Donald Trump, is not recognized with a decision – “bombshell” received today by an American court.

Specifically, the former US president can normally be prosecuted for alleged crimes committed during his presidency in order to overturn the results of the 2020 presidential election, according to a decision made today by the federal appeals court.

This decision is a significant blow to his basic defense in the January 6 case. The decision by the appeals court comes after the Supreme Court declined to rule on whether Donald Trump has presidential immunity, referring the matter to the Court of Appeals at the request of special counsel Jack Smith.

The former president had then argued that what Jack Smith had imputed to him was part of his official duties as president of the United States and therefore protected from criminal liability.

“For purposes of this criminal case, former President Trump has become a Trump citizen, with all the defenses of any other defendant. But any executive immunity that may have protected him while he served as President no longer protects him from this prosecution.”the court said.
