Louisiana Vincent Simmons has been released from prison after 44 years in prison for trying to rape two 14-year-old twin girls. He passed through the prison gate free, just three days before he turned 70.
Over the years, Simmons has tried at least 16 retrials to prove his innocence and that in 1977 he was not given a fair trial.
His request went unfulfilled until the evidence he was trying to bring to court was presented by CBS shortly before his hearing on Monday afternoon.
The most important element presented by CBS is the report of the doctor who examined one of the girls, from which it appears that he was a virgin. The doctor also wrote in his report that there were no signs of sexual assault on either of the two girls. The test was conducted two weeks after the day the girls complained of being raped.
Another piece of evidence that was never presented to a judge was the testimony of the girls to the sheriff about the alleged attack. The girls initially told police they did not know who attacked them. According to the file, they said he was black and “all blacks look alike”. They even used the extreme racist word known as “N-word”.
This testimony, which according to experts could acquit Simmons of the accusations, the defense complains that it was hidden from her. The prosecution, on the other hand, claims that it gave the defense full access to the case file.
“He is happy and grateful and prays but he does not know what will happen,” Justin Bonus, Simmons’s lawyer, told CBS.
“As for not being angry, this is with Vincent. If I were Vincent I would be angry. He is not. “He forgives them because revenge is not something that expresses him,” he added.
The sisters, now 59, were also due to appear in court on Monday. As they said in an interview with CBS last week, they still insist that they were victims of Simon and that he is guilty.
