The former president’s judges are calling for the appeal court’s ruling to be overturned and have called on the Supreme Court to stay the appeal court’s decision until it decides whether to hear the case.
The American Ex president donald trump asked the US Supreme Court to overturn a lower court ruling earlier this month that ruled he was not immune.
A US federal appeals court on February 6 rejected an argument by Trump’s lawyers that the case in which he is accused of trying to sway the outcome of the 2020 presidential election cannot go to trial because he was president at the time and therefore enjoyed immunity.
All proceedings in the case had been suspended due to an appeal filed by Trump’s lawyers, which had forced Judge Tanya Chatkan to announce the postponement of the trial, which was originally scheduled to begin on March 4.
The appeals court ruling would have gone into effect Monday unless Trump appealed to the Supreme Court, which he did.
The ex-president’s judges are seeking to overturn the appeals court’s decision. They have also called on the Supreme Court until it decides whether to accept the case, to suspend the implementation of the appeal court’s decision.
If the Supreme Court refuses to stay the appeals court’s ruling, Trump’s trial in the case is likely to begin in the spring.
Trump’s lawyers are claiming “full immunity” for his actions while he was president and warned in their appeal to the Supreme Court that denying a president immunity would set a dangerous precedent.
“Without immunity from criminal prosecution, the presidency as we know it will cease to exist,” they underline.
Trump, the favorite to win the Republican nomination for the November election, has been charged in four separate cases. The former president is trying to delay their trial and the issuing of decisions as long as possible and in any case after the elections.
