The judge who will preside over his trial Donald Trump and his 14 co-defendants in the illegal attempt to overturn the election result in the State of Georgia in 2020 today rejected the exemption request of the prosecutor Fannie Willis, but set certain conditions to remain in the case.
Judge Scott McAfee concluded that there was insufficient evidence to establish a “conflict of interest” because Willis had formed a bond with an attorney to whom she had assigned the case. However, judging her to have made a “blunder” and denouncing a “gross lack of judgement” on Willis’ part, he called on her to either withdraw herself and her entire team, or to withdraw her subordinate, Nathan Wade, to whom she had delegated duties special counsel to handle the Trump case.
Four separate criminal trials are pending against Trump, the Republican nominee for the November presidential election against Democratic incumbent Joe Biden. He is trying, with successive appeals, to delay the trial as long as possible, if possible until after the elections. No date has been set for his trial in Georgia at this time.
Four of the 19 defendants in this trial have already pleaded guilty. They were given short suspended sentences in exchange for their testimony at the future trial of the others. Among Trump’s co-defendants are his former personal attorney, Rudy Giuliani, and former White House chief of staff Mark Meadows. Trump, who has pleaded not guilty, is accused of illegally pressuring state officials to overturn his loss to Biden in the 2020 Georgia election.
Willis and Wade testified at that trial that their relationship began after the latter was hired. Prosecutors argued that their bond had nothing to do with the case because it did not harm the defendants. Defense attorneys accused prosecutors of perjury, insisting they had an affair before Wade was hired. In court documents filed Feb. 23, Trump’s lawyers presented Wade’s cell phone tracking data, suggesting he made several late-night visits to Willis’ home before she appointed him as special counsel.
Today, a lawyer for the former president said his team would use “all available remedies” to have the case dismissed.
