An unknown lawsuit for murder and genocide was filed today in France by a woman who accuses Israeli authorities of being responsible for the deaths of her two grandchildren in the Gaza Strip in October 2023.
The appeal concerns the death of Tzana and Abderachim Abudaher, aged 6 and 9, who were killed on October 24, 2023 when they were in the northern part of the Gaza Strip, “which was hit by two missiles launched by the Israeli army”.
The appeal has been filed by Jacqueline Rivos, a grandmother on the side of the children’s mother, for murder, a crime against humanity, genocide and synergy with these two crimes.
The lawsuit, announced today by lawyer Ariene Alimi, was filed with a Paris court in the department responsible for crimes against humanity and aims to appoint an investigator in the case.
The fact that the two children had French nationality may allow the French court to rule on the charges of “genocide”, which is categorically rejecting Israel, describing them as “scandalous”.
The Human Rights Association (LDH) intends to participate in the appeal.
The blow was launched 17 days after Hamas’ attack on Israel, which was a trigger for the still raging war.
Various appeals have been filed against the charge of “genocide” in countries such as Switzerland, the Netherlands or Germany.
Three appeals have been lodged in France in recent months against members of French -Israeli associations or a soldier of the Israeli Armed Forces on the charge of genocide or synergy in genocide.
What is mentioned in the document
The appeal refers to the crime of genocide, as Jacqueline Rivo’s lawyers estimate that the bombing that cost life in her grandchildren is part of a plan with the aim of “eliminating the Palestinian people and to submit it to living conditions that lead to its destruction”.
According to the appeal, the Israeli army against Gaza after October 7thd forced the family to leave their home on October 22 in the evening and seek refuge in a relative and then a relative.
Eventually the family was hit by two rockets when it was in a third house “in the northern part of the Gaza Strip, between Falouza and Bait Lahia”. One rocket “hit the roof and the second directly the room where the family was.”
Abderachim died “on the spot” and Tzana shortly after being transported to a hospital. Their brother Omar was seriously injured but remains alive and is in Gaza with his mother Yasmine Z.
Yasmine Z, also injured by this attack, was sentenced to Paris in 2019 for funding of terrorists for giving money to Islamic Jihad and Hamas from 2012 to 2013. A warrant is pending against her.
International accusations against Israel for genocide
The International Criminal Court (ICC) has issued a arrest warrant against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Joav Galad on charges of committing war crimes and crimes against humanity.
The International Federation of Human Rights (FIDH) was the first to accuse Israel in December 2023 of committing genocide against the Palestinians, and a year later was followed by Amnesty and the Human Rights Observatory (HRW).
In January 2024, the International Court of Justice asked Israel to prevent any genocide action.
UN humanitarian header called on world leaders in May to “act to prevent genocide”.
