A federal judge on Wednesday rejected the Trump government’s request to make public the minutes of the Grand Jury related to criminal investigation into sexual crimes convicted, Jeffrey Estain in Florida in the mid -2000s.
The decision does not affect two other pending applications by the Ministry of Justice (Doj), who seek access to the minutes of the Public Prosecutor’s Committee related to later federal investigations into Estain and his associate, Ghislaine Maxwell, in New York.
These procedures led to criminal prosecutions against them in 2019 and 2020, respectively.
The Trump government has filed applications for the expulsion of the Public Prosecutor’s Practices last week, after days of strong criticism of the Ministry of Justice’s decision to hide evidence of the investigation of Estain, despite previous commitments to disclose them.
The Ministry of Justice’s request to the Western District Federal Court in West Palm Beach, Florida, called for the opening of the practices of two jury committees that convened there in 2005 and 2007.
The ministry argued that the disclosure of practices – which usually remain secret – is justified by ”Strong public interest in historical research on Jeffrey Estain“
He also argued that “many of the arrangements that safeguard the confidentiality of the affidavit” based on federal criminal proceedings “no longer apply”, since Estain died in 2019.
OR judge Robin RosenbergIn her decision, she rejected the request, citing 2020 decision by the 11th Court of Appeal, covering the states of Florida, Alabama and Georgia. That ruling stipulates that a regional court does not have the power to seduce practical jury committees in cases not covered by the relevant criminal rule.
None of the Ministry’s arguments meet the exception of this rule, Rosenberg wrote in her decision on Wednesday.
“The case -law of the 11th Regional Circle does not allow this court to satisfy the government’s request; the hands of the court are tied up – something that the government accepts“, The judge wrote.
