British Prime Minister Kir Starmer’s immigration policy was hit after a court ruling to suspend the expulsion of an asylum seeker.
A man from Eritrea will not be deported to France tomorrow in the context of the “one inside, one out” policy after gaining his appeal to the Supreme Court for temporary suspension of deportation, Sky News notes.
The man, who arrived in the United Kingdom after a trip via Italy and France, was due to be deported on a commercial flight on Wednesday at 9am.
He would be the first to return to France in accordance with the terms of the new agreement between the United Kingdom and France for the return of immigrants.
However, the lawyers who represented him warned the Supreme Court that the man could remain blatant if he returned to France tomorrow.
The interior ministry claimed that he could have asked for asylum in France when he first arrived there before coming to the United Kingdom in August.
However, Judge Sheldon was in favor of the immigrant and imposed a temporary suspension of his deportation.
Sheldon said: “I will grant a temporary suspension for a short period of time.”
The decision was taken following a decision by the National Referral Mechanism (NRM) – which identifies and evaluates the victims of people’s slavery and marketing – and the NRM invitation to the man to submit further observations.
This is the first legal challenge of the government’s agreement with France on the return of immigrants.
