Justice releases R$ 1.3 billion to pay INSS retirees’ shares; see who receives

by

The CJF (Council of Federal Justice) released, this Tuesday (24), R$ 1.260 billion for the payment of RPVs (Small Value Requisitions) to retirees, pensioners and other insured persons who defeated the INSS (National Institute of Social Security). ) in lawsuits.

The amounts will be allocated to 81,180 beneficiaries who won 63,522 processes for granting or reviewing retirement, pension or disability and assistance benefits and had the payment order issued by the judge in April. The money will be in the account until the beginning of June.

RPVs are delayed by up to 60 minimum wages (R$72,720 this year) paid in lawsuits filed in the Federal Special Court. The deposits of the amounts take place within two months after the judge’s payment order, when the process comes to an end, without any possibility of appeal by the INSS.

Those who had the arrears released in April will have the money between the end of May and the beginning of June. The exact date depends on the schedule of each TRF (Federal Regional Court). At the TRF-5 (Federal Regional Court of the 5th Region), which serves states in the Northeast of the country, the processing of the money has already begun. The release of credit is scheduled to occur from June 1st.

At the TRF-3 (Federal Regional Court of the 3rd Region), which serves the states of São Paulo and Mato Grosso do Sul, processing has also started and should be completed within seven days. The forecast is to start paying the amounts soon after. Sought, the other courts did not position themselves.

How do I know if I will receive INSS RPVs?

The consultation to release the arrears is made by the insured or his lawyer. Those who have a defender can check with the professional himself what the payment forecast is. In general, actions of up to 60 minimum wages do not need a lawyer to be proposed.

Citizens can check their process on the website of the court in the region where they are served. In São Paulo and Mato Grosso do Sul, the consultation is done on the website www.trf3.jus.br. It is possible to find out information by case number, by the lawyer’s OAB (Brazilian Bar Association) number or by the insured person’s CPF.

To know if you will receive this batch, you need to observe the dates. In May and June, RPVs whose “TRF protocol date” is any day of April 2022 are paid. After payment, “Total payment to the court” will appear. The money will fall into the account opened by the court at Banco do Brasil or Caixa Econômica Federal.

Ask questions about the benefit review

1 – Who can request a review?

  • Insured people who believe they are receiving a benefit in error or who disagree with the INSS’s analysis of it

2 – What is the deadline to place the order?

  • It is up to ten years, counted from the first day of the month following the receipt of the first benefit. Example: if the first payment was in November 2012, the insured has until December 2022 to file a review request

3 – How to know if there is an error?

  • There are two main ways to find out if there was an error. The first one is checking the grant letter and the benefit calculation memory, where there is information on how the INSS analysis was carried out. These documents must include all salaries considered for the calculation of the benefit and an indication of those that were discarded.
  • The second way to know if the INSS was wrong is by analyzing the PA (administrative process) of the benefit. You must apply online, at meu.inss.gov.br or through Central 135

4 – What documents do I have to present?

  • To apply for a review, you need to submit basic documents in addition to paperwork that proves your entitlement to a higher income. See what they are:

>Personal documents such as RG and CPF
>Copies of receipts proving higher salaries
>Copy of the PPP (Professional Social Security Profile), for those who will request special time
>Copy of payslip to prove that the salary was higher than that considered in the INSS account
>Copy of the labor lawsuit in which the insured was victorious, with the signature of the notary’s employee

5 – What are the most common mistakes that lead to having a lower benefit?

  • The review is linked to any failure in the granting act, which may be committed by the INSS, when it fails to consider a document presented, or by the insured person himself, who did not include sufficient documents and evidence of his contribution time.
  • There are also other flaws of the institute, such as not granting the best possible benefit to the worker or applying a disadvantageous rule, for example.
