Mônica Bergamo: Proving eventual plagiarism of Golden Bull is difficult, says copyright expert

Despite its enormous resemblance to the work “Charging Bull”, or Bull of Wall Street, in New York, specialists say that it would be difficult to qualify as plagiarism the statue Touro de Ouro from B3, the Brazilian Stock Exchange, inaugurated in São Paulo in day 16.

“The sculptures are distinct, each animal with its own positioning, specific muscle reliefs and even peculiar facial expressions. There would be similarity in the concept of the work. However, for copyright purposes, the theme of the work tends to be seen as a an abstract idea and, therefore, incapable of being exclusively appropriated by a single person”, says lawyer Raul Murad, professor of intellectual property at PUC-RJ.

The sculpture of the New York bull, carved by the Italian artist Arturo di Modica, was made in bronze. The Brazilian version, designed by artist and architect Rafael Brancatelli, has Styrofoam inside and is gilded.

The choice of the bull as a symbol of the financial market is because it represents the stock market’s high moments, as it is an animal that horns upward.

Brancatelli said to sheet who did not plagiarize di Modica’s work. “I didn’t copy any project. From the beginning I wanted it to be something different. Some people even blame me for not being like other bulls.”
