Azul must pay BRL 5,000 to a passenger for flight cancellation in the pandemic

Azul Linhas Aéreas Brasileiras must pay R$5,000 to a passenger for moral damages due to the cancellation of a flight during the pandemic.

The decision, reported by Aeroin, is from the First Specialized Civil Chamber of the Court of Justice of Paraíba, which dismissed Azul’s appeal against the judgment of the 2nd Mixed Court of Araruna.

In the appeal, Azul stated that the flight from Porto Alegre to João Pessoa was canceled due to the relocation of the air network, given the restrictions of Covid, and that the national air network underwent several changes and cancellations and stopped serving several locations due to the pandemic.

The rapporteur, Judge José Ricardo Porto, declared that it was uncontroversial that there was a failure to provide the service by the airline: “The amount of compensation for moral damages must be maintained, as it is fixed according to the peculiarities of the specific case, as well as observing the principles of proportionality and reasonableness”.
