After the increase in the volume of labor lawsuits due to the pandemic, lawyers who monitor the matter are projecting a new wave of lawsuits involving, mainly, problems with overtime and vaccination requirements in 2022.
So far, issues related to dismissal for lack of structure for remote activity, in addition to the right to disconnect from work, have stood out in the pandemic scenario, according to Priscilla Carbone, partner in labor law at Madrona Advogados.
There are also lawsuits about breaches in agreements to reduce working hours and wages, and return of pregnant women to face-to-face work.
In Carbone’s assessment, the number of new lawsuits should grow again because many employees are waiting for the court’s position to file their actions, especially in cases where there is still no clarity, such as the dismissal of employees who refuse the vaccine.
Rafael Ferraresi, from Ferraresi Cavalcante Advogados, also mentions the labor discussions about the home office, as many dismissed professionals decided to file lawsuits related to overtime.
The movement of cases of this type is expected to increase in 2022, still driven by the uncertainty in the economy, says the lawyer.
