See three situations that can lead the INSS to suspend the BPC

One of the main criteria for receiving the BPC (Benefício de Prestação Continuada) is income. Elderly people and people with disabilities are entitled to the benefit if the income per person in the family (per capita) is up to a quarter of the minimum wage, which amounts to R$ 303 this year.

If the income increases, the INSS (Instituto Nacional do Seguro Social) can cut the BPC. However, this is not the only cut-off rule and citizens need to be aware of issues related to updating the CadÚnico (Single Registry).

This is what happened to Maria das Graças, a resident of Rocinha, in Rio de Janeiro. When he turned 65, in December 2020, his son Alexandre applied for the BPC. In April 2021, the institute asked the family to comply with the requirement, updating the information in CadÚnico.

Alexandre says the update was made on time, but it was not included on time in the pension systems, and on May 17, 2021, the request was rejected. The same day, he appealed.

A month later, with no response, he asked for the benefit again and, until the end of June of this year, the request was “under analysis” in the INSS system. wanted by Sheetthe institute initially reported that both requests had been rejected.

According to the INSS, the first request was rejected for not complying with the requirement within 30 days. The second was denied due to the fact that the insured does not meet the legal requirements that entitle the beneficiary. “The insured person has a per capita family income above that established by law (one quarter of the minimum wage), which makes him ineligible for the benefit”, informed the agency.

INSS grants benefit

However, a few days later, Alexandre was contacted by the agency with a clearer explanation. “I received an email from the INSS saying that there was a requirement: declare the income of a family member. It was the MEI Income Tax [Microempreendedor Individual]. We declared it in minutes, sent the receipt through the Meu INSS app and, three days later, I received an email confirming that the application had been granted.”

The request had been barred because Alexandre’s brother, who is part of the family group, has a CNPJ and contributes to the INSS as MEI, but without formal income. “He only contributes to retiring in the future, as it is informal.”

Information is cross-referenced between agencies

According to social security lawyer Rômulo Saraiva, it is not exactly the declaration that the MEI makes to the Federal Revenue that can lead the INSS to cut or deny the benefit, but the existence of the CNPJ.

“A presumption is created that, with the linkage to the MEI, the person is receiving their own income and maintaining their own subsistence to the point that they do not need to receive the BPC. In cases where the MEI is inactive, it is important that this circumstance be clarified in order to justify the need to be included in the BPC”, recommends the expert.

The INSS explained that the MEI declaration is not a requirement for the benefit.

In this case, however, the citizen needs to make the declaration to the IRS so that the situation is up to date, as the agencies cross the data.

“The INSS, which runs the assistance program, usually uses information from CadÚnico and MEI”, says Saraiva.

​1 – Change in the family’s economic situation

According to Rômulo Saraiva, the change in the economic situation of the family group is one of the main causes of cutting or denial of the benefit. “It is enough for someone in the family to start earning an income that can de-characterize the initial status of family poverty”, he explains.

The income per person of the family group must be less than or equal to a quarter of the minimum wage. For the calculation, the gross monthly income of family members is added together. The amount must be divided by the number of people that make up the group.

Income transfer programs, such as Auxílio Brasil, benefits and assistance of an occasional and temporary nature, remuneration of the person with a disability as an apprentice or trainee and BPC or retirement in the amount of up to one minimum wage are not included in the calculation. These values ​​must be registered and updated in CadÚnico.

In the account, family members who live under the same roof as those who apply for the benefit, including a spouse, partner or companion, are considered; parents and, in their absence, stepmother or stepfather; unmarried siblings, children and stepchildren; and minors under guardianship.

2 – Do not update CadÚnico

Failure to update the Cadastro Único can also lead to the suspension of the benefit. Thus, attention is recommended to the INSS requirements, which can come by email or by consulting the CadÚnico application.

It is also necessary to be aware of the Meu INSS application and it is recommended to keep the address updated, so as not to miss any correspondence that comes through the Post Office.

It is possible to request the reactivation of the benefit at a distance, by calling 135, or at the Social Security agencies.

3 – Evolution in the health framework

An improvement in the health situation may justify the interruption of the BPC for people with disabilities. Citizens who have long-term impediments (for at least two years) of a physical, mental, intellectual or sensory nature can receive the benefit, which may impede their full and effective participation in society on an equal basis with other people.
