Cade (Administrative Council for Economic Defense) condemned, this Wednesday (3), five companies and six individuals for forming a cartel in Infraero’s bids for the concession of cafeteria areas in several airports. Added together, the fines amount to R$ 4.7 million for anti-competitive practices.
The companies Alimentare, Ventana, Confraria André, Boa Viagem and Delícias da Vovó will have to pay fines of more than R$ 3.8 million. Individuals will pay approximately R$ 965.3 thousand.
In addition to the fines, all are prohibited from participating in public tenders for five years, and the suspension period that has already been completed after Infraero’s decision on the same case is deducted from this period.
Documents from seven face-to-face trading sessions, which took place between May and November 2014, were investigated. The lawsuit began in 2015.
According to Cade, the companies acted to block the contracting auctions at airports in the cities of Campo Grande (MS), São Paulo (SP – Congonhas), Florianópolis (SC), Maceió (AL), Recife (PE) and São José dos Santos. Pine forests (PR).
Marcus Ely Soares dos Reis, a lawyer for Alimentare, states that the punishment is unfair, as the company had already been punished by Infraero in an administrative proceeding, and, according to the Law and Jurisprudence, it is not possible to be punished twice for the same fact. .
“They convicted a defendant of the company just for being on the social board as a partner, and that is not justified,” he said. Reis said the company will appeal.
THE Sheet could not contact the companies Ventana, Confraria André, Boa Viagem and Delícias da Vovó until 10:30 am this Thursday.
